Marina managers hash out subcontractor issues

The implications of independent subcontractors stepping into a boatyard or marina highlighted the importance of liability insurance for marina managers who attended the International Marina and Boatyard Conference this past weekend in Atlanta.

Dennis Nixon of the University of Rhode Island told marina managers that their most important meeting is with their lawyers to review insurance coverage.

“The liability is more magnified for megayacht marinas,” said Jim Bronstien of Marine Business Advisors.

“Sometimes you have to say no to customers or subcontractors. That’s business,” said Mike Esposito, president of Irish Boat Shop in Harbor Springs, Mich. You have no control over someone who just pops onto your lot in a van, he added.  

The panelists who weighed in on the discussion, ‘Independent Subcontractors: Friend or Foe,’ agreed that exclusive dealers servicing engines under warranty are reputable subcontractors.

Marina owners were also encouraged to charge a daily access fee to subcontractors, implement worker access agreements, and ask for proof of subcontractor insurance and insurance limits. General liability insurance stops at the water’s edge.

“Worker access insurance transfers liability back to them (the subcontractor) on your property,” said Mark Yearn of Marine Insurance Services in Milford, Mich.   “This is all about risk and reward,” he said. “How much are you willing to take?”
